This license governs the use of the accompanying software ("Software"), including all associated media, printed or electronic documentation, and any updates or patches to the software provided by Cloud Code ("Provider"). The Software is made available to participants of the Cloud Code Developer Kickstart Program ("Program") for the purpose of personal education and skill development. By downloading, accessing, or using the Software, you ("User") agree to the terms of this license. If you do not agree to the terms of this license, do not download, install, access, or use the Software.
Subject to the terms of this License, the Provider grants the User a non-exclusive, non-transferable, limited license to use the Software solely for personal educational purposes as part of the Program. This License does not allow the Software to be redistributed or used for any commercial purpose.
The User shall not:
- Distribute, sell, lease, rent, lend, or sublicense the Software to another person or entity.
- Make the Software available on a network where it could be used by multiple devices at the same time.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
- Modify, or create derivative works based upon the Software in whole or in part.
- Remove any proprietary notices or labels on the Software.
The Software is licensed, not sold. This License does not transfer to the User any title to or ownership of the Software, or any intellectual property rights therein. The Provider and its licensors retain all right, title, and interest in and to the Software, including all related intellectual property rights.
This License is effective until terminated. The User's rights under this License will terminate automatically without notice from the Provider if the User fails to comply with any term(s) of this License. Upon License termination, the User shall cease all use of the Software and destroy all copies, full or partial, of the Software.
The Software is provided "AS IS", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and noninfringement. In no event shall the Provider be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Software or the use or other dealings in the Software.
To the extent not prohibited by law, in no event shall the Provider be liable for personal injury, or any incidental, special, indirect, or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to the User's use or inability to use the Software, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if the Provider has been advised of the possibility of such damages.
This License constitutes the entire agreement between the User and Provider relating to the Software and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by the Provider.
